The complaint should not be upheld because the Trustee is required to pay the pension increases specified in the Fund’s governing documentation (such increases being capped at 3%, subject to any overriding statutory underpin) and in accordance with pensions legislation.
The complaint/dispute is upheld against The Trustee and the Employer.

I do not uphold this complaint against USS as it has applied the Rules of the Scheme correctly and I do not find that Professor M relied on the Quotation in making his decision to withdraw from the Scheme.
