I do not uphold this complaint, and no further action is required by the Trustee. 

Complaint summary

Mr S as the executor of the Estate, has complained that:-

  • The Trustee failed to use its discretionary power to pay Mrs S a higher benefit as a serious ill health lump sum (SIHLS); and

  • The Trustee failed to treat his initial complaint as a complaint under the Scheme’s Internal Dispute Resolution Procedure (IDRP), despite his request for it to do so. 

He would like the Trustee to compensate the Estate for the consulting fees Mrs S incurred for transferring her benefits out of the Scheme, and for the distress and inconvenience she also suffered.
